Terms of Service

1. Acceptance of Terms

By accessing or using Babesky (“the Service”), including by creating an account or completing the onboarding process, you confirm that you have read, understood, and agree to be bound by these Terms of Service (“Terms”) and all policies incorporated by reference, including our Privacy Policy and Content Policy.

If you do not agree to these Terms, you may not access or use the Service.

2. Eligibility

You must be at least 18 years old to use Babesky. By creating an account, you represent and warrant that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into a binding agreement
  • You are not prohibited from using the Service under the laws of your jurisdiction
  • All information you provide is accurate and truthful

Babesky is an adult content platform. We take age verification seriously. Access by minors is strictly prohibited.

3. Account Registration

To use the Service, you must register an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorized access at [email protected]

You may not transfer, sell, or share your account with any other person. We reserve the right to terminate accounts that violate these Terms.

4. The AT Protocol and Decentralized Identity

Babesky is built on the AT Protocol, an open, decentralized social networking protocol. By using the Service, you acknowledge that:

  • Your profile data and public posts may be replicated across the AT Protocol network
  • Babesky operates as an App View on top of the AT Protocol; your DID (Decentralized Identifier) and public records may be accessible to other AT Protocol clients
  • You can migrate your account and data to another AT Protocol-compatible service at any time
  • Deletion of content from Babesky does not guarantee immediate removal from all AT Protocol relay infrastructure

5. User-Generated Content

5a. Your Content

You retain ownership of all content you post to Babesky. By posting content, you grant Babesky a non-exclusive, worldwide, royalty-free license to display, distribute, and transmit your content solely as necessary to operate the Service.

5b. Content Standards

All content must comply with our Content Policy. Content that violates our Content Policy may be removed and your account may be suspended or terminated.

5c. Representations

By posting content, you represent and warrant that:

  • You own the content or have all necessary rights and permissions to post it
  • The content does not violate any third-party intellectual property rights
  • All individuals depicted in any content have consented to that depiction
  • All individuals depicted in any adult or sexually explicit content are 18 years of age or older

6. Prohibited Conduct

You agree not to:

  • Post content involving minors in a sexual context (zero tolerance; immediate account termination and report to NCMEC)
  • Impersonate any person or entity
  • Harass, threaten, or abuse other users
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure
  • Use the Service for any unlawful purpose
  • Scrape or systematically collect user data without authorization
  • Circumvent any access controls, subscription gates, or monetization features
  • Attempt to reverse engineer any part of the platform

7. Subscriptions and Payments

Certain features of Babesky require payment. By subscribing or making a purchase:

  • You authorize Babesky to charge your payment method for the agreed amount
  • All sales are final unless otherwise stated; chargebacks initiated in bad faith may result in account termination
  • Subscriptions auto-renew unless cancelled before the renewal date
  • Prices may change with 30 days’ notice to subscribers

For creator payouts, separate Creator Agreement terms apply and will be presented at the time of creator enrollment.

8. DMCA and Intellectual Property

We respect intellectual property rights. If you believe content on Babesky infringes your copyright, please submit a DMCA takedown notice to: [email protected] with the subject line “DMCA Takedown Notice.”

Your notice must include:

  1. Identification of the copyrighted work claimed to be infringed
  2. Identification of the allegedly infringing material and its location on our platform
  3. Your contact information
  4. A statement of good faith belief that the use is not authorized by the copyright owner
  5. A statement, under penalty of perjury, that the information in the notice is accurate
  6. Your physical or electronic signature

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. BABESKY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BABESKY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

11. Governing Law

Babesky is, as of the Effective Date of these Terms, a pre-incorporation project operated by a distributed group of founders. No operating entity has yet been registered in any single jurisdiction.

Once Babesky’s operating entity is formed, this Section will be updated to specify the governing law, exclusive jurisdiction, and dispute resolution mechanism that apply to these Terms. Material changes to this Section will be subject to the notice requirements in Section 12 below.

Until an operating entity is formed, disputes between you and Babesky will be resolved by good-faith negotiation in the first instance. Where negotiation does not resolve the dispute, the dispute will be governed by the applicable law of the jurisdiction in which the dispute arises. The absence of a specified governing law in this Section does not waive any other rights or defenses available to Babesky or to you under applicable law.

12. Changes to These Terms

We may update these Terms at any time. We will notify users of material changes via email or an in-app notice at least 14 days before the change takes effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
